Article 1 (Introduction)
These Terms of Service (hereinafter referred to as the “Terms”) set forth the rights and obligations between CATAIWA (hereinafter referred to as “we,” “us,” or “our”) and users (hereinafter referred to as “you” or “user”) regarding the use of services provided by us, including our website, smartphone applications, and browser-based games (collectively referred to as the “Service”).
The Service includes smartphone game applications and games playable on web browsers provided by us (hereinafter referred to as the “Game”).
Before using the Service, you must read the full text of these Terms carefully, understand them, and agree to them. By starting to use the Service, you are deemed to have agreed to these Terms.
We may modify these Terms as necessary. The revised Terms shall take effect at the time they are notified to users by methods separately specified by us (such as announcements within the Service or publication on our website). You are deemed to have agreed to the revised Terms as well, so please check the latest version regularly.
Article 2 (Use of the Service)
You may use the Service in accordance with these Terms and any rules within the Service.
You are responsible for your own use of the Service.
When using the Service, you must not engage in the following actions:
- Modifying, decompiling, disassembling, or otherwise reverse engineering the Service or the Game
- Intentionally exploiting bugs or defects in the Service, or sharing such information with others
- Unauthorized access to the Service or attempts to do so
- Infringing on intellectual property rights, privacy, reputation, credit, or other rights or interests of third parties
- Violating laws or public order and morals
- Interfering with the operation of the Service
- Any other actions that we deem inappropriate
Article 3 (Advertisements)
Advertisements provided by third-party advertising services (such as Google AdMob) may be displayed within the Service and the Game at our discretion.
In certain features of the Game, such as hint functions, you may be able to view hints by watching rewarded advertisements. Viewing such advertisements is optional and at your own discretion.
The content of advertisements and responsibility for their distribution lie with the advertisers. We assume no responsibility for the content of advertisements.
Article 4 (Disclaimer)
We make no warranties, whether express or implied, regarding the completeness, accuracy, safety, usefulness, or fitness for a particular purpose of the Service.
We shall not be liable for any damages arising from your use of, or inability to use, the Service. However, this shall not apply in cases of willful misconduct or gross negligence on our part.
In the event of any dispute arising between users or between a user and a third party in connection with the Service, such dispute shall be resolved at the user’s own responsibility and expense, and we shall not be involved.
We may change, suspend, or terminate the Service without prior notice.
Article 5 (Intellectual Property Rights)
All rights related to the Service and the Game (including but not limited to copyrights, patents, trademarks, design rights, know-how, and ideas) belong to us or to third parties with legitimate rights.
You do not acquire any of these rights through the use of the Service, and you may not infringe upon these rights (including reproduction, modification, distribution, public transmission, transfer, or lending) without our prior written consent.
Article 6 (Miscellaneous)
Matters not stipulated in these Terms shall be resolved through good faith discussions in accordance with applicable laws and customary practices.
These Terms shall be governed by the laws of Japan.
Any disputes related to the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
